Regulatory framework

The activity of selling trips and stays is strictly regulated by the Tourism Code.

It is regulated by the public authorities in order to guarantee the safety of consumers. To be able to practice legally, any professional in the sector must be registered in the National Register of Travel and Stay Operators, managed by Atout France.

This registration certifies that the operator meets legal obligations, in particular:

  • The possession of a financial guarantee, ensuring the reimbursement of funds paid by customers in case of default;
  • The subscription of a professional liability insurance, covering possible damages related to the activity.

Since July 1, 2018, the Tourism Code has also incorporated the provisions of European Directive (EU) 2015/2302, strengthening the protection of travelers in the context of the sale of package holidays and related travel services.

Preamble

COLORS TRAVEL, SAS with a capital of €10,000, registered with the RCS of Paris under the number 988 365 581, has its head office at 60, rue François 1er — 75 008 Paris.

The company is registered at Register of travel and stay operators held by Atout France under the number IM075250045.

It offers tourist services (golf holidays, circuits, etc.) intended for individuals (groups or individuals) as well as for businesses, under the commercial brand Green.

Insurance and financial guarantee

La professional liability by COLORS TRAVEL is covered by the company HISCOX, contract no. HSXIN320066811A.

La financial guarantee, mandatory for travel operators, is insured by Arcus.

These Special Conditions of Sale have been established in accordance with articles L.211-1 and following of the Tourism Code, as part of the transposition of European Directive (EU) 2015/2302, which came into force in the context of the organization and sale of package holidays and packages, excluding the sale of dry flights.

These provisions also take into account European regulations and international conventions in force, in particular those relating to air transport.

Advance customer information

The General and Special Conditions of Sale have been communicated to the customer before signing the travel contract, in accordance with article R.211-4 of the Tourism Code, and are an integral part of prior information. They may, if necessary, be supplemented or replaced by all or part of the particular conditions of sale of the supplier (tour operator), which will also be brought to the attention of the customer before the conclusion of the contract.

Information relating in particular to the price, the terms of transport, the conditions of cancellation, the course of the stay will be systematically communicated to the customer before the final signature of the contract.

Acceptance of the Conditions

By validating his travel contract, the customer expressly acknowledges having read and accepted:

  • The General and Special Conditions of Sale,
  • The specific conditions of the organizer when these apply,
  • And detailed descriptions of the chosen trip.

In the event of contradiction between these general and/or special conditions of sale and the provisions contained in the travel contract, the terms of the contract will prevail.

Booking terms

The services offered on the site are subject to availability. The reservation is only considered final after written confirmation from the Travel Agency. According to the provisions of article 1369-8 of the Civil Code, the Customer accepts the use of electronic media as a method of concluding the contract.

Prices are established on the basis of exchange rates, air fares and the cost of ground services known at the date of sending a tariff proposal or a published tariff offer (example: newsletters, social networks, etc.).

In accordance with Directive (EU) 2015/2302, the customer is provided, before the conclusion of the contract, with the mandatory standard information in the form of a registration form, a secure private page, a sales contract and/or any appendices.

The combination of travel services offered constitutes a tourist package within the meaning of article L.211-2 II of the Tourism Code, resulting from the transposition of Directive (EU) 2015/2302.

Consequently, the customer benefits from all the rights provided for by European Union law in terms of tourist packages, as integrated into the French Tourism Code.

The company COLORS TRAVEL assumes all legal obligations applicable to travel organizers.

The rates are indivisible:

Any renunciation of one or more services included in the package, or any interruption of travel at the initiative of the customer — regardless of the cause (including in the event of hospitalization or early repatriation) — will not give rise to any reimbursement, unless specific insurance covering this risk has been previously taken out by the customer.

The prices are established on a fixed basis, in number of nights (not days), and include, depending on the service booked:

  • transport (air, sea and/or land),
  • the taxes known on the day of the order,
  • accommodation,
  • car transfers or rentals,
  • green fees,
  • the visits or excursions planned in the program,
  • as well as application fees.

The customer acknowledges and accepts that the fixed price includes services whose details are set by the organizer.

No claim relating to the price of the trip can be accepted after the return. It is up to the customer to validate, before registering, the price displayed. Any price changes will be communicated prior to booking and confirmed in the travel contract.

Registration and required information

All registration requests must be accompanied by the traveller's full contact information, including:

  • Name and surname,
  • Date of birth,
  • A copy of the valid passport or CNI, depending on the entry conditions of the chosen destination.

Payment terms

The total price of the service is that shown on the travel contract or the order confirmation sent by the Agency. It is expressed in Euros and including VAT.

Booking more than 45 days before departure

The full payment airline service (flights + taxes) is required to confirm the reservation. One 30% minimum deposit of the amount of land benefits is also required.

The deposit can be paid via one or more secure electronic payment links. COLORS TRAVEL uses the 3D Secure system to guarantee the protection of bank data. All information entered or collected is encrypted to ensure confidentiality.

The Travel balance must be paid no later than 45 days before the departure date.

Booking 45 days or less before departure

The full settlement The total amount of the service (air and ground) is required at the time of booking.

Accepted payment methods

The customer can pay for his order using the following bank cards:

  • Visa
  • Eurocard/MasterCard

In accordance with article L.132-2 of the Monetary and Financial Code, any payment made by bank card is irrevocable. The customer can only oppose the payment in the event of loss, theft or fraudulent use of the card. Any commercial dispute or desire to circumvent the absence of the right of withdrawal constitutes a fraudulent act.

Upon confirmation of the reservation, the full amount of the deposit or order, including any costs, will be taken immediately from the customer's bank card.

Bank data security

The agency does not process or store customer banking data directly. This data is transmitted securely to the banking institution via an encrypted server in accordance with current standards. They are only used in the context of the execution of the contract (payment, possible reimbursement, additional costs).

The customer expressly accepts that his bank details be transmitted to the agency's partner bank in order to proceed with the payment of the services ordered.

Important:COLORS TRAVEL will never ask the customer to transmit all of their bank details by email or telephone. In the event of a request of this type, the customer is invited not to respond and to inform COLORS TRAVEL immediately.

Fraud prevention

As part of fraud prevention and identity verification, the customer may be asked to provide:

  • a partially hidden copy of his bank card (with only the first 6 and last 4 digits visible);
  • a copy of his identity document.

Any other complete sending of bank data, without explicit request from the agency, is the sole responsibility of the customer.

The performance of the booked services does not become final until full payment of the amount due has been received. Any non-payment, transaction rejection or banking incident may automatically result in the cancellation of the order at the initiative of the customer.

The following are not considered to be effective or discharging payments:

  • The simple communication of a bank card number, without validation by the secure payment system;
  • The transfer order not followed by the execution of the transfer.

Travel information

1. Administrative formalities and traveller responsibility

Before registering, each traveller must ensure, according to their personal situation and nationality, that they are in possession of the required and valid documents (passport, national identity card, visa, ESTA, authorization to leave the country, etc.) necessary for the execution of the trip and for entry into the countries of transit and/or destination.

Some countries and service providers (customs, airlines, local authorities, etc.) may require the transmission of personal data (name, first name, date of birth, gender, etc.) appearing on the identity document used to travel. This data will be transmitted, if necessary, for the purpose of processing mandatory formalities.

Attention:The information provided during the reservation (name, first name, date of birth, gender) must strictly correspond to the information on the identity document. Any error or inconsistency may result in denial of boarding or entry into the country, without the possibility of reimbursement.

The information provided by COLORS TRAVEL is valid for French nationals. Travellers of other nationalities should consult the competent authorities. It is the responsibility of the contract subscriber to relay information relating to formalities to all participants.

COLORS TRAVEL cannot be held responsible for:

  • the refusal to enter a territory in the event of non-conformity of travel documents,
  • any delay, additional cost, or impossibility to travel resulting from the absence or invalidity of the required formalities.

No refund can be granted in the event of cancellation or impossibility to travel due to a lack of administrative documents.

2. Formalities — Safety — Health — Accessibility — Transmission of information

2.1 — Visas and administrative formalities

COLORS TRAVEL does not intervene in the procedures for obtaining visas or entry authorizations. The client must personally carry out all the necessary procedures, at his own expense, with the competent authorities (consulates, embassies, official platforms, etc.).

2.2 — Safety and health information

Travellers are invited to consult the country sheets of the Ministry of Europe and Foreign Affairs (www.diplomatie.gouv.fr) to find out about security conditions and health recommendations. This information may change until departure: it is up to travelers to consult it regularly. COLORS TRAVEL may, for certain destinations, require the signature of the corresponding MEAE form.

For health information, it is recommended to consult the sites of the competent authorities, in particular:

  • Ministry of Health,
  • World Health Organization (WHO),
  • Pasteur Institute:https://www.pasteur.fr/fr

And to report to the Travel Agency any health problem requiring follow-up or special assistance.

2.3 — Minors abroad — Authorization to leave the country

Since January 15, 2017, any minor who is not accompanied by one of his parents with parental authority must be in possession of the following documents to travel abroad:

  • A valid identity document (national identity card or passport depending on the destination);
  • The exit authorization form (AST), duly completed and signed by the parent or legal representative (CERFA Form No. 15646*01).

2.4 — Accessibility

COLORS TRAVEL services can be adapted to people with reduced mobility or with specific needs. It is the responsibility of the traveller to report any constraint or particularity at the time of the request in order to offer an adapted trip. For transport services (especially air transport), the required assistance must be requested at the time of registration, to allow appropriate organization.

2.5 — Transmission of information

The person registering the group undertakes to transmit to all participants the information provided by COLORS TRAVEL. The agency cannot be held liable in the event of omission or poor transmission of this information by the subscriber.

Modification and transfer of the contract

Modification/transfer by the customer

Any request for Postponement of date Or of change of destination is considered a cancellation and results in the application of the corresponding cancellation fees.

A change in the traveller's name is not a simple change, but a transfer of contract subject to the conditions and transfer fees set out below.

Any modification or interruption of the stay at the initiative of the customer once there (e.g.: shortened stay, services not voluntarily consumed) will not give rise to any refund, total or partial.

In accordance with the Tourism Code, the customer has the possibility of transferring his travel contract to a third party, as long as it has not produced any effect, i.e. before departure and provided that the service has not yet begun.

The request for transfer must be sent to COLORS TRAVEL within a reasonable time, by any means allowing it to be acknowledged, and this before the start of the trip.

The transferee (the person to whom the contract is transferred) must meet the same conditions as the initial customer in order to benefit from the service (e.g. health conditions, administrative formalities, administrative formalities, required documents, etc.).

The transferring customer and the assignee remain jointly and severally liable:

  • the payment of the balance of the contract,
  • as well as any costs incurred by the transfer (fees charged by service providers or companies, processing fees, etc.), which will be communicated to the customer at the time of the request.

Some amounts incurred are not transferable or transferable in the event of a change in the trip. These include:

  • insurance taken out (cancellation, multi-risk, etc.);
  • costs for visas, vaccinations, sending documents, as well as pre- and post-delivery costs (e.g.: transport between the customer's home and the place of departure or arrival);
  • application fees invoiced by the agency;
  • air transport if the ticket is issued: it will not be exchangeable or refundable by the airlines and therefore, the transfer of the travel contract may be assimilated to a cancellation generating costs.

Modification by the agency

Modification of an essential element of the contract

In accordance with article L.211-13 of the Tourism Code, if, before departure, an external and unforeseeable event is imposed on COLORS TRAVEL and requires it to modify an essential element of the contract, except in cases of exceptional and unavoidable circumstances referred to in articles L.211-16, the customer will be informed by any means allowing it to be acknowledged.

The customer will then receive an alternative proposal, among the following options:

  • Acceptance of the proposed changes (partial modification or alternative trip);
  • Cancellation of the contract free of charge, with full reimbursement of the amounts paid.

Minor contract changes

In accordance with article L.211-12 of the Tourism Code, COLORS TRAVEL reserves the right to unilaterally modify, before the start of the trip, non-essential elements of the contract, provided that they are minor changes.

These changes may include, for example:

  • The replacement of a hotel by another of an equivalent category;
  • Changing boats for a cruise;
  • A change in the order of visits to a circuit.

In this case, the customer will be informed in writing, on a durable medium (email or letter), without this constituting a cancellation of the contract.

Airline provisions

In accordance with the legal provisions in force, COLORS TRAVEL informs the Customer, when developing the travel program, of the identity of the air carrier (s) likely to operate the flights, as well as the planned schedules and any known stops on this date.

In the event of a change after registration, COLORS TRAVEL undertakes to communicate to the Customer, as soon as it is aware of it and until departure, any change in the identity of the air carrier.

In accordance with article L.224-66 of the Consumer Code, boarding taxes collected on unused and fully paid tickets are refundable on request.

Conditions of transport

The conditions applicable to air transport (baggage allowance, tariff conditions, on-board services, etc.) fall under the policy of the airline operating the flight. This information is available on the carrier's website or can be provided by COLORS TRAVEL on request.

COLORS TRAVEL recalls that, in accordance with the international regulations applicable to air transport, airlines may change departure or arrival schedules, routes, stops and airports without notice. These changes do not, in themselves, constitute a valid reason for cancellation at no cost on the part of the Customer.

In case of events outside COLORS TRAVEL, such as:

  • technical incidents,
  • adverse weather conditions,
  • strikes,
  • political turmoil,
  • airspace saturation,
  • or any other circumstance constituting force majeure or a fortuitous event,

COLORS TRAVEL cannot be held responsible.

If the airline originally planned cannot operate the flight, COLORS TRAVEL reserves the right to use another company under comparable conditions.

Formalities and assistance in the event of an incident

It is up to the Customer:

  • to respect the registration deadlines and procedures set by the company (especially online);
  • to keep all travel documents (tickets, boarding passes, luggage tags, etc.);
  • to immediately request any supporting documentation from the carrier in the event of an incident (delay, cancellation, denial of boarding, loss or damage of luggage).

The Customer must send his complaint directly to the airline, attaching a copy of the supporting documents and keeping the originals. COLORS TRAVEL may, as assistance, assist the Customer in dealing with the company.

Delivery before and after the trip

When the Customer organizes his pre-routing and/or post-routing services himself (rail transport, accommodation, etc.), COLORS TRAVEL recommends choosing tickets that can be modified at no cost and/or refundable, and to provide reasonable correspondence margins.

COLORS TRAVEL cannot be held responsible or make any reimbursement in the event of non-use of these services, nor for the financial consequences induced by:

  • delays,
  • cancellations of flights or trains,
  • or any other unforeseeable event affecting the smooth execution of the trip originally booked.

Cancellation conditions and fees

In accordance with article L.211-14 of the Tourism Code, the customer may cancel the travel contract at any time before departure, subject to payment of the cancellation fees provided for in the contract.

The Customer must notify COLORS TRAVEL of his decision in writing (registered letter or email with acknowledgement of receipt). The date of receipt of this writing by COLORS TRAVEL will be the only one used to calculate the cancellation fees.

These fees correspond to a standard schedule or, in some cases, to the specific conditions of the providers (non-refundable or specific services). The Special Conditions of Sale or the quotation may also provide for a specific scale applicable to certain services.

COLORS TRAVEL standard scale (excluding special conditions or real costs)

  • More than 120 days before departure:€100 per person administrative fees
  • 120 to 50 days before departure:30% of the total amount of the package
  • From 49 to 30 days before departure:45% of the total package amount
  • From 29 to 15 days before departure:65% of the total package amount
  • From 14 to 08 days before departure:85% of the total amount of the package
  • From 07 days until departure:100% of the total amount of the package

Special cases: dry flights or charter flights

The cancellation conditions mentioned above do not apply to dry flights (flights only without associated ground services) or to travel on charter flights.

The cancellation fees for a dry flight vary according to the fare conditions and can be up to 100% of the ticket amount upon reservation, in particular for non-modifiable or non-refundable rates (promotional rates, low-cost, etc.). The Customer is informed of these specific conditions at the time of booking.

In the context of a trip including a charter flight, all the amounts paid for this flight will be retained in the event of cancellation, regardless of the date of the cancellation, due to the contractual conditions imposed by the carriers.

Return tickets that are not used, for any reason whatsoever, will not give rise to any refund, even partial.

Price revision

The prices communicated are established taking into account the economic conditions in force on the date the quotation was sent, in particular:

  • The cost of transport, including in particular the price of fuel. International transport services are paid in euros to our partner air carriers.
  • Air taxes, disembarkation at ports and airports. The amounts indicated correspond to the taxes known at the date the quotation was sent.
  • The exchange rate of the currencies used to calculate the cost price of services. These rates are set at the date of publication of the programs.

In accordance with articles L.211-12 and R.211-8 of the Tourism Code, COLORS TRAVEL reserves the right to adjust its prices up or down, within the legal limits provided, and this, according to the following modalities:

1. Change in the exchange rate

If a significant change in the exchange rate affects the total price of the trip by more than 8%, this variation will be fully reflected, both up and down. This exclusively concerns services invoiced in foreign currency to COLORS TRAVEL, which can represent 30 to 70% of the total cost of the trip.

2. Variation in transport costs and taxes

Any change in the cost of fuel or other taxes applicable to the services included in the contract (examples: port, airport, tourist taxes), will result in a correlative revision of the selling price.

In the event of a price revision, the Customer will be informed in a clear and detailed manner, on a durable medium, no later than 20 days before the start of the trip. The information will include the justifications for the variation and the method of calculation applied.

In accordance with article R.211-9 of the Tourism Code, if the increase exceeds 8% of the total price of the package, the Customer will be expressly informed of:

  • price increases;
  • its deadline for accepting or refusing the modification;
  • his right to cancel the contract free of charge with a full refund within 14 days;
  • the consequences of a lack of response, namely the application of contractual resolution fees.

Insurances

Taking out insurance (cancellation, assistance, repatriation, etc.) is optional but highly recommended. It allows, where applicable, to obtain a reimbursement of the costs of resolving (cancelling) the travel contract, subject to declaration by the Customer and study of the file by the insurer, depending on the adequacy between the declared event and the guarantees actually taken out.

Before subscribing, the Customer has access to:

  • General conditions and specific conditions of the contracts offered;
  • Guarantee tables;
  • Clearly stated warranty exclusions.

Right to renounce

In accordance with applicable regulations (article L112-10 of the Insurance Code), the Customer benefits from a 14 day cancellation period from the date of subscription of the insurance contract, provided that:

  • the insurance contract has not produced any effect (i.e., the trip has not yet been cancelled or started), and
  • the Customer proves that he already benefits from equivalent coverage for the same guarantees.

Any request for renunciation must be sent in writing, accompanied by the necessary supporting documents.

Responsibility

COLORS TRAVEL cannot be held responsible for the consequences resulting in particular from the following events:

  • Loss or theft of tickets (example: plane tickets) by the passenger (s);
  • Non-presentation of the required documents (administrative, health, passports, visas, vaccination certificates, etc.) necessary for completing the trip, entering the countries visited or crossing borders, when these obligations have been brought to the attention of travelers;
  • Delay by the traveller at check-in or boarding, especially for air travel, leading to denial of boarding. In this case, no refund of the ticket can be required;
  • Unforeseeable and/or unavoidable facts relating to third parties, such as: wars, political unrest, social movements outside COLORS TRAVEL, riots, technical or administrative incidents, natural disasters, exceptional weather conditions, breakdowns, delivery delays (in particular postal), flights or losses of luggage or personal effects of travelers.

In the event of exceptional and unavoidable circumstances, or imperative security reasons (including administrative injunctions), COLORS TRAVEL reserves the right to change the dates, times or itineraries initially planned, without this giving rise to the right to compensation.

Financial responsibility

In the event of the liability of COLORS TRAVEL resulting from a failure of its service providers, the applicable compensation ceilings will be those provided for by the international conventions in force (example: air, rail, maritime transport), in accordance with article L.211-17 IV of the Tourism Code.

Except in the case of personal injury, COLORS TRAVEL's financial liability is limited to a maximum amount equivalent to three times the total price of the trip per person.

In case of insolvency, the amounts paid by the customer will be refunded. If insolvency occurs after the start of the trip and the package includes transport services, the repatriation of travelers will be taken care of and guaranteed.

Personal information

In accordance with the General Data Protection Regulation (RGPD) and the law “Informatique et Libertés” n° 78-17 of January 6, 1978 as amended, the personal data collected by COLORS TRAVEL, SAS registered with the RCS of Paris under the number 988 365 581 (head office: 60, rue François 1er — 75 008 PARIS), are treated as data controller.

Some data, indicated by an asterisk when booking or requesting a quote, are mandatory. Otherwise, the request cannot be processed. The purposes of the treatment include:

  • the execution of the travel contract,
  • the management of requests,
  • the communication of commercial offers subject to your consent,
  • analyses in compliance with the rules in force, to providers and partners of COLORS TRAVEL, including those located outside the EU, exclusively for the purposes of the execution of the contract.

Data is kept for the time necessary for contractual management and to meet legal obligations.

You have a right of access, rectification, opposition, opposition, deletion, deletion, deletion, portability, limitation of processing, as well as the right to define the fate of your post-mortem data. Finally, in accordance with article L223-2 of the Consumer Code, you can subscribe to the list of opposition to telephone canvassing:www.bloctel.gouv.fr.

Traveller's law

In accordance with Directive (EU) 2015/2302, the proposed combination of services constitutes a tourist package within the meaning of article L.211-2 II of the Tourism Code.

As such:

  • The traveller benefits from all the rights provided for in this regulation.
  • COLORS TRAVEL is legally responsible for the proper execution of all the services included in the package travel contract.
  • In the event of insolvency, COLORS TRAVEL has a financial guarantee from Arcus, allowing the reimbursement of payments made and, if transport is included, the repatriation of travelers.

The traveller may contact this entity if services are refused due to the insolvency of the organizer.

Complaint

Any complaint relating to a service included in the package must be sent by registered mail with acknowledgement of receipt, in a 20-day delay from the date of return of the Customer.

The complaint must include:

  • a clear statement of the facts,
  • useful supporting documents (tickets, invoices, invoices, certificates, photos, etc.),

and be sent by post or email to the following address:

If no satisfactory response has been provided within 60 days from receipt of the complaint, the Customer may file a complaint free of charge with the Tourism and Travel Mediator (MTV), with a view to an amicable settlement of the dispute:

In the event of a purchase made online, the Customer has the option of using the online dispute resolution platform provided by the European Commission.

Right of withdrawal

In accordance with article L.221-28 of the Consumer Code, this travel contract is not subject to any right of withdrawal.

In addition, in accordance with article L.223-2 of the Consumer Code, the Customer acknowledges having been informed of his right to subscribe to the list of opposition to telephone canvassing, available on the site:www.bloctel.gouv.fr
